The final settlement timeline and the 14-day rule
Article 53 gives an employer fourteen days. Most disputes about timing come down to two questions: fourteen days from when, and what is the employer allowed to wait for. This page walks the whole sequence from notice to payment.
The rule
"The employer shall pay to the worker, within (14) fourteen days from the end date of the contract term, his wages and all his other entitlements stipulated herein and resolutions issued for its implementation, the contract or the establishment's by-laws."
Three things follow from the wording. The clock starts at the end of the contract, not at the resignation letter and not at visa cancellation. It covers everything — wages, gratuity, leave pay, notice pay where it is owed, and contractual entitlements such as a contractual bonus. And nothing in the article makes it conditional on the worker signing anything.
The sequence, step by step
| When | What happens | Provision |
|---|---|---|
| Day 0 — 1 May | Written notice given by either side | Article 43(1) |
| 1 May – 30 May | Notice period. Contract remains in force; full wage continues; service keeps counting | Article 43(2) |
| During notice | If the employer gave notice: one unpaid day a week to look for work, on three days' warning | Article 43(5) |
| 30 May | Contract ends. The 14 days start | Articles 43(2), 53 |
| By 13 June | All wages and entitlements due | Article 53 |
| From 14 June | Unpaid amounts are overdue; complaint to MOHRE is available | Article 54 |
If the worker is on annual leave when notice is given, Article 35 says the notice period does not start until the day after the scheduled return from leave, unless both parties agree otherwise. That can move the whole timeline by weeks.
What the employer can and cannot wait for
Clearance and handover
Returning a laptop, an access card, a company car; handing over files. These are ordinary and reasonable. They are not a condition in Article 53. An employer can deduct the value of genuinely unreturned property only within the limits the law allows, and should itemise it. It cannot hold the entire settlement until a clearance form comes back.
A signed "full and final" release
Payment of amounts that are due does not depend on signing a waiver of other claims. If the settlement document includes a release you do not agree with, you can decline to sign that part and still insist on payment of the undisputed amounts. See the settlement checklist on what to look for before signing.
Visa and permit cancellation
Cancellation is a separate administrative process, and it can run in parallel. The 14 days run from the end of the contract regardless of where the cancellation has got to. See visa cancellation and final settlement.
The next payroll run
"We pay settlements with the monthly payroll" is a policy, not a legal basis. If the next payroll falls on day 20, the settlement is six days late.
Disputed and undisputed amounts
A disagreement about one line does not suspend the deadline for the others. If the employer accepts that 40,000 AED is owed and disputes a further 5,000, the 40,000 is due within the 14 days. Insist on that in writing. Keeping undisputed money back as leverage is one of the commonest reasons settlements drag.
Equally, a claim for damages — Article 47 compensation, for example, which a court assesses — is not a fixed entitlement on day 14. It follows its own route.
What day 15 looks like
- Write to the employer. State the date the contract ended, the amount you say is due, and that the Article 53 deadline has passed. Ask for payment or a written explanation by a specific date. Keep a copy.
- Ask for the calculation if you have not had one: the basic wage used, the service period, the number of days, and each other line.
- File with MOHRE if it is not resolved. MOHRE tries to settle the dispute amicably and, for claims up to 50,000 AED, can now decide it. See how to file a MOHRE complaint.
Federal law does not attach an automatic daily penalty, payable to the worker, to a late settlement. That is a difference from the DIFC and ADGM, which both do. The remedy on the mainland is the complaint route, and MOHRE's own powers over employers who do not pay.
Deadlines in other regimes
| Regime | Deadline | Runs from |
|---|---|---|
| Federal law (mainland and most free zones) | 14 days | End of the contract, Article 53 |
| Federal alternative savings scheme | 14 days | Termination, for the scheme balance |
| Domestic workers | 10 days | Contract expiry, Decree-Law No. 9 of 2022, Article 19(9) |
| DIFC | 14 days | Termination date, with a daily late-payment penalty |
| ADGM | 21 calendar days | Last day of employment, with a late-payment penalty |
Time limits for complaining
Separate from the 14 days is the time you have to bring a claim. Federal Decree-Law No. 9 of 2024, in force from 31 August 2024, amended Article 54 of the labour law; law-firm commentary on the amendment consistently describes a two-year period from the end of the employment within which a claim must be brought. Some official pages written before the amendment still describe a one-year limit. Treat the shorter figure as the safe one and do not wait. For domestic workers the limit is three months.
The date the contract ended is the anchor for every deadline on this page. Keep the resignation or termination letter, the employer's acknowledgement, and anything that shows the last working day. If those dates are ever disputed, that is the evidence.
Questions
How long does a UAE employer have to pay the final settlement?
Fourteen days from the end of the contract, under Article 53 of Federal Decree-Law No. 33 of 2021. It covers wages and all other entitlements.
Can my employer delay my settlement until I finish clearance?
Clearance and handover are reasonable, but Article 53 does not make payment conditional on them. Unreturned property can justify an itemised, lawful deduction — not withholding the whole settlement.
Does the 14 days start when my visa is cancelled?
No. It starts from the end of the contract. Visa and work-permit cancellation is a separate process.
